Default I was fired from a job I had for a year. The old employer says their HR...

...dept will say I was terminated.? How do I put the reason I was fired from this employer? Plus, I was employed for a year. Do I put this job on a resume and how do I mention why I got fired in an interview?

No employer can legally say anyone was terminated. All an employer is allowed to say is whether or not you worked there and for how long. They are not legally allowed to speak of salary, job performance or the conditions for which you left. What I would do is have someone call (someone who can sound professional) and request a reference. See how they are responding. If they are speaking negatively of you or saying anything other than "yes they worked here from x to x" you have a nice lawsuit on your hands. Not that you would necessarily want to spend the money to sue but a threatening and professionally worded letter would do the trick. A company is not allowed to prevent you from finding employment elsewhere.

Don't leave it off of your resume. A year is a long enough time. Besides a year long gap looks worse on a resume than a year long job.

As far as the reasoning for firing....just say you were laid off due to company cutbacks. Never say you were "fired" laid off is a much nicer way of putting it.
